As communicated earlier online, the Fair Work Commission (FWC) listed a hearing yesterday (17.11.2022) on whether to suspend/terminate the current protected industrial action between Svitzer and its employees. This included the notification from Svitzer of the possibility of an indefinite lockout of its workforce, set to commence 12 pm AEDT, Friday, 18 November 2022.
Following the adjournment of the FWC hearing yesterday, Svitzer released a statement last night confirming the planned lockout will not proceed.
The FWC hearing will continue today on whether to suspend or terminate all protected industrial action between the Svitzer and its workforce. The FWC is expected to make an order before midday AEDT.
Whilst we are pleased to share this information with you, we do still anticipate impacts to Maersk vessels and ultimately, Maersk customers. We are working steadfastly to find solutions and remain hopeful this impact will be manageable with all parties committed to serving Australian supply chains.
We will continue to assess the impact of this latest development and any further developments in relation to the FWC hearing, on a vessel-by-vessel basis over the next few days. We will continue to keep you informed through relevant advisories for any possible cargo and or schedule impact in due course, which we hope will be limited.

We have been advised that the Fair Work Commission (FWC) has issued a statement and directions listing a hearing to decide whether or not to suspend or terminate protected industrial action by Svitzer.
The hearing is planned for 12.00 pm (AEDT) today, 16/11/2022. We will endeavour to communicate feedback from this hearing as soon as possible.
